Hi

I just wondered with all the new legislation going on and the cookie fiasco.. What does a new site have to have in order to be covered legally ?

And does anybody have generic details for:
1. Terms and conditions
2. privacy policy &
3. cookies policy

where can I get these things ?

It may be a tough question as there really are no 'generic' details. There is a 'what to look for', I guess, but nothing written down on paper. So here is an answer from memory:

Terms & Conditions - What to look for

T&C Bad Terms
* Minimum Player Rule - Where the program expects a specific number of players per month in order to pay you out
* Minimum Activity Rule - Where the program expects a specific amount of player activity per month in order to pay you out
* Forced Promotion - Where the program expects a certain level of promotion in order to pay you out

T&C Terms many don't like
* Negative Carryover Rule - Where the program carries over your negative earnings balance to the following month instead of zeroing it out
*Bundling - Where negative earnings from one casino wipes out positive earnings from another casino in the program's client base

Those are just a few from memory, but are terms to watch out for :)

Privacy Policy

No matter what a program states, they don't follow it. The only who *may* follow it are programs who are public entities (i.e., bound by their shareholders). Don't expect your email address, home address, or phone number to be secure.

Cookies Policy
There are none, everyone does it differently and everyone has a different opinion on how it should work.

Hope that helps!

Thanks GuardDog, but I was thinking more for my own site not what to look out for on affiliate program sites. More to cover my own ass :)

Ah.. Not sure I understand, then.

I can understand a privacy policy if you are taking emails in. That is important (and even more important to follow it).

T&C's.. depends upon what you do.

Cookies.. unless you are running an affiliate program, I don't know what you would put here. Programs themselves generate the cookies, not you.

Google "Free Privacy Policy" and you will find a tool to help you with that.
Terms and conditions like Guarddog said depend on what youre doing with your site.

Cheers

As I understand this. I think societyofslots is looking for the same I have been wanting to finally get put up on website / forum.

Cookies policy might be because of the new cookie law? bbc.co.uk/news/technology-18194235]BBC News - Cookie law: websites must seek consent from this weekend

Hope it is okay linking to BBC? :)

Also in regards to Terms and Conditions and Privacy policy.

As I understand when you run a website which advertises for gambling (affiliate). Then you need to protect yourself with these.
Like people has to be over 18. That our website takes no responsibility if a visitor goes to a online casino shown and looses a lot of money.
Then the T&C covers you and Privacy Policy as well.

Hope it is okay also linking to casinomeister here is example from there which shows really well > casinomeister.com/legal.php]Legal Statement and Privacy Policy at Casinomeister

I hope I have not totally misunderstood everything here asked or discussed here. As I would then have made a laugh of myself ;)

There's plenty of stuff you're supposed to do (varies depending on your/your target jursidiction), but tbh most affiliates just ignore them.

For example, in the UK you're supposed to link to gamble aware, show the 18+ logo and only promote white listed brands. I personally do this (for the most part) but it's mainly so I can use PPC on adwords more than anything else (google UK's gambling license requires you to be ASA compliant).

As for the ridiculous cookie law, it's a joke and many big mainstream sites are ignoring it. If you're worried, just stick up a message that says "This site uses cookies. By continuing to use this website you accept our cookie use. More details about cookies here...".
