Hey guys posted the other day but no one responded. Is promoting offshore like Bovada illegal to do in the US? Everyone is doing it still but what are some ways to safeguard yourself. Any help on this would be appreciated.

This whole forum is about online casino promotion I am sure someone has some more insight on this that is already promoting Bovada in the US. Anyone else that can help please chime into this conversation.

No one knows your circumstances precisely, it's wise to get legal advice. As a rule of thumb, promoting Offshore Casinos to US players is not permitted.

Wouldn't that technically answer your question?

Do you live in the US or not? Enforcing US laws outside the US would be quite challenging, and probably a waste of their time and money if you are not some super big company that brings millions of revenue. And even then if you are hosted outside the US, and not on a .com domain, there's not much they can do about it, as you would be lawyered up.

The way these things usually go is IF the affiliate does something that's not permitted, the Regulator fines the Book/Casino, which makes them take action against you by asking you politely or not so much to change your methods. From that point you start to get the idea if someone has a problem with you and the business you do, and can act accordingly.

And even after this there are many things that can be done. When I first came to Switzerland, I was contacted by a body that tried to present itself as a government gambling agency of some sort, but then I found out from my lawyer, they were a daughter company of the monopolist Swisslos.

My point is, a gambling lawyer can really answer everything that you need to know and help you proceed, especially if you live in the US, as you would have local state laws and federal US laws and it gets even more confusing.

P.S: Also "some guy told me on the forums it was okay" is not a valid excuse, so it doesn't really matter what anyone here including myself tells you. Don't bet your future on it.

It may not matter but I, for example, never write the names of countries in Spanish. It is simply a review. Perhaps this could be the case with Bovada. Simply descriptions in English without US flags or references to the US.
The problem is that Bovada seems to only accept players from the USA. But that's info from years ago I don't know how it is now. So this tactic may not work.

But in general, as above, if you don't live in the location it's not a problem.

Probably as a short-term project it can be done. If there is a demand. But in the long term it seems unnecessary.

@eddiep20 - if your making as much money as you claim you are (other posts), then your not short of a buck, and can afford to get proper legal advise. AGD is not a legal-help site, we're affiliates. I'm not aware of any member here being a qualified lawyer.

You would also need to check state law along with federal, best ways is no problem worse is big fines and potentially more problems? Would you trust a froum with that?
