Good Day!
Our company name is WeWe Media and we are working in the Affiliate Marketing Industry for more than 10 years.
We would like to request for your help regarding an unprofessional situation we have been dealing with for several months and seek for best advice and guidance further from your teams.
We started doing business with Trafficash in March 2021 and promoted their offers (from Paris Casino and LeJackpot Casino) for the French market, but never got paid.
We have a total outstanding payment of 11685eur (made up of 57 FTDs out of 345 Registrations).
The payment terms are Monthly Net15, but they delayed the payment week after week and never respected the agreement and the signed IO including the NET payment terms. We have been discussing with other partners and understood they have this practice with multiple traffic companies which find themselves in the same situation as we do.
At no time they advised they will not be paying for a certain reason, and they only kept insisting that they will honour their payment, however met us with a delay each week.
The Affiliate Manager -we have there - Noah - is not replying anymore and it has been more than three months since we are trying to get a hold of them via skype/ email and still no reply.
We have screenshots with our skype conversations and the commission from their system, including the IO signed by both parties.
Such operators cannot hide behind shady practices like this, and simply refuse any further communication and not pay the commissions. In the moment we advised we will take legal action back in June, they asked us not to do so, as they will respect their commitments and it will ''harm'' their business if we will proceed as such; as the time passed by, we understand it was just another way to get everything delayed and eventually to get away with it. We contacted another member of their team too and tried to solve this with them multiple times, but each time we got the same delays.
We also have an IO signed by them and by us that states the following:
''The Parties hereby agree as follows: Advertiser will make use of WeWe Media’s Services under the WeWe Media T&C. These WeWe Media T&C are exclusively applicable between Parties for Framework Agreement and underlying Agreement and future Agreements. Any (general) terms and conditions of Advertiser are hereby explicitly rejected. By signing of this Framework Agreement, Advertiser agrees that the WeWe Media T&C have been received and agreed upon by Advertiser.''
We have sent a legal letter as well to their email addresses to which we still have not received any reply since last week.
We would really appreciate your expertise into running a fair investigation into this case and have a resolution in the nearest future.
