An interesting use of h3 sub-headings

Hello, this well-ranking post has caught my eye: https://www.capitol-casino.com/top-10-greatest-poker-players-of-all-time/

They don't use any H2's in this post, only h3s. Also, all these sub-headings are shown as bullet points in their featured snippet.

My questions:

1. When is it okay to use h3s like that? Or did they get lucky by skipping the h2?
2. How does Google recognize these headings as a list? Is it because of wording/column, or does the fact that they use h3's, not h2's also matter?

I think if it as an essay for college. Use them as you would when making an outline. For instance.

H1 = I
H2 = A)
H3 = 1A)
2A)
3A)
H2 = B)
H2 = C)

However, some sites are still ranking using multiple H1's which is a no-no. I try stick to using one (maybe 2, which I should not do and end up having to change it to an H2, which causes more work) H1's if I am feeling aggressive, Mostly H2, and H3 for sub topics. Sometimes I throw in H4's but it is usually for FAQ.

I see on some pages they use H4s instead of H2s (hxxs://www.capitol-casino.com/games/black-jack/).

My guess is that they don't understand how to use heading tags correctly and are only using them for stylistic purposes.

They would probably rank even better if they used the correct format.

Those h3s are not h2s since they are very short and are not completely different topics (would make no sense to have that many h2s). So I would say they nailed it, but forgot to include an h2.

I have made many experiments using H1-H6 in many ways. The best way so far has been:
H1 Title
H2 Important topic
H3 related to important h2 - topic
H4 related to H3
H4 related to H3
H2 An other important topic
H3 related to this topic
H3 related to this topic

Also, i skip using h-tags on footer and sidebars if they are cross-over.

I have / had a site with one h2 before a table that had h3 for the casinoname on each row. This table contains more than 100 casinos so its MASSIVE in terms of H3 - usage but google liked it! Even got my table displayd as a snippet on some results.
