Betfair Italy - Doesn't pay €97,000 - UNRESOLVED

Greetings,
I rely on the great experience of this Forum to deal with this case with you, which is followed by my lawyer.

I have been collaborating with Betfair since 2023 and in all these months we have never had too many problems, until the new affiliate Brenner got in touch with me to discuss the future of our affiliation in a video call, they say that the traffic is excellent and that I am achieving great results, they ask me for more details on how this traffic is generated and which Telegram groups we rely on. This happened in January.

Payments, as you know, often take place at the end of the following month, so in February we are paid the January commissions, for the entire month of February we generate around €35,000, continuing to communicate with the friendly manager without problems, March begins and we arrive at the end of the month with a revenue of around €47,000 but the February payment is delayed in arriving, I am reassured that there are delays also on other affiliates, and therefore I continue to generate traffic also for April, until the 15th of the month for another €15,000, from that moment the clarification emails intensify, where I am repeatedly put on hold while they are carrying out checks, but everything is normal.

Suddenly the affiliate managers stop responding to the emails, so I send a payment reminder email to the Italian company, this on April 25th, I don't receive any response and on May 14th I send another one complete with attached invoices and request of payment.

Today May 17th I receive their response, where they claim that my traffic is fraudulent and that the account will be closed and all commissions unpaid.

Now that traffic may no longer be of interest I can understand, I've been working in this sector for 15 years, I've seen it all too, but not paying €97,000 in commissions, I find it absurd.

I hope for them that they have excellent arguments to bring to court, because that is where I will drag them with all their data and all the affiliates they have defrauded over the years.

If an affiliate is no longer profitable, you must stop it immediately and pay what it generated for you, closing any type of future activity. You don't let him work for months, also because there have been CONTINUOUS exchanges of emails with the Aff. Manager and NO ONE has ever invited me to stop traffic!

Flutter - PaddyPower - Betfair doesn't end here, arm yourself with a lot of patience even if you chose the wrong asshole this time.

So let me get this right... No website, all traffic is generated via "Telegram groups".

Unlike most igaming operators who actively take steps to hide their business dealings, 'Flutter Entertainment plc' DO NOT. They are a public traded company.

Not sure how successful your law suit would be, given, they're a Plc ;)

Not even via the website, the fact that it is listed on the stock exchange does not matter, in Italy they operate with an SRL which is Betfair under the Italian ADM license, they respond to Italian laws and courts.

I hope they want to find an agreement and pay the commissions, the aff. managers disappeared, without giving me any more answers.

Today they hide behind T&Cs that honestly do not protect the affiliates but only their interests, we will see how legitimate it will be to withhold commissions for 3 months without EVER telling me to stop the traffic, but they had to wait for 2 legally official emails from me.. . they acted clearly in bad faith.

I'm not au fait with Italian Laws in regards to their online gambling licensees.

I'm just merely pointing out that, even if you manage to get them to court, they'll have an army of legal council, who, will probably use every trick in the book, to postpone, defer and adjourn the case for years, if they can. By which time, most people will have run out of money...

As far as not telling you to STOP sending traffic... while I agree it's 100% unethical and dodgy, I'm not sure there are laws to protect you from this unconscionable behavior. A lot of these BIG companies do as they please. Takes the likes of Ladbrokes, WillHill, 888, etc., etc., all thieving crooks, but still in operation.

@Giocaplaynow Sorry to say, but we did not hear back from the representatives. We sent a reminder email in hopes we will get some updates this time. Keep you updated.
