German Market Closure - BeAffiliates Update

BeAffiliates informed us they have decided to terminate all their activity in the German market.

Email received:
"Dear affiliate,

We would like to inform you that, due to changes in our current Business strategy, we have decided to proceed with the termination of all our activity in the German market.

As such, we ask you to, please, remove any brand communication, banners, textlinks and similar, for the above-mentioned brand and market.

As per clause 3.7.1 of our Terms and Conditions, “(…) we will pay commissions on all Active Player activity, up to the point the player account is closed. Once the player account is closed, there will be no further activity and you will therefore not earn any further Commission Fees on these specific players(…)”. The accounts closure will take immediate effect on the 15th of April.

As stated however on clause 3.7.1., “In the event that we terminate all promotional activity in a particular jurisdiction solely for business reasons (and without change in applicable laws or policy), and are unable to supply required 30 days’ notice the provisions of Clause 9.2. shall apply”, therefor, and in this particular case, “(…)you shall nevertheless be entitled to compensation for a thirty (30) day period from the date of notice of termination(…)”.

3.7.1 Right to Exclude All Marketing or Player Activity in a Jurisdiction

We may close a market and all or some player accounts in that jurisdiction for legal, business or any other reason whatsoever. In this event, we will pay commissions on all Active Player activity, up to the point the player account is closed. Once the player account is closed, there will be no further activity and you will therefore not earn any further Commission Fees on these specific players.

In the event that we terminate all promotional activity in a particular jurisdiction solely for business reasons (and without change in applicable laws or policy), and are unable to supply required 30 days’ notice the provisions of Clause 9.2. shall apply

Please note we may also require you to remove all marketing materials including banners from your websites and the websites of your sub affiliates, (if applicable) with immediate effect, and we may disable such banners ourselves to the fullest extent possible. Furthermore you may be required to cease all email marketing initiatives and any other marketing activity. In this event, you agree to comply with immediate effect. Failure to do so may result in the closure of your account without prejudice to other rights and remedies hereunder for all and any damages which may ensure as a direct result of your failure to so comply.

9. Term and Termination

9.2 We may also terminate this Agreement immediately for business reasons or other reasons of internal policy and control. We shall endeavor to provide the requisite minimum thirty (30) days prior notice, however, where this is not feasible, you shall nevertheless be entitled to compensation for a thirty (30) day period from the date of notice of termination, based on the amounts paid to you with respect to the immediately preceding 30 days. The foregoing shall be notwithstanding a shorter period for player account closure and removal of all promotional banners and advertising activity.

Wow, they do not even thank existing affiliates for their cooperation? What a shame :(
More than 10 years ago expekt used to be a quite decent brand with an okish sportsbook (and exceptional winter sports offers), great cs and good casino product. Shit started when they were bought by Mangas group/ Betclic who also wasted 80 Million usd for everest poker and several millions more for sponsorship deals for juventus turin, OL Lyon and OL Marseille et al.
One or two years ago i contacted BeAffiliates since at least the casino product still wasnt that bad and wanted to promote it. Could have sent easily 25 + FTDs a months, but they made it very clear they didnt want any German traffic at all. Lucky me.
