Problematic T&C's - Are these new?

Was thinking about giving these guys a run but after reading the following T&C's, I'm going to pass.

9. The Affiliate program can change the Partner's balance due to this cause for an unlimited period of time after detection of fraudulent activity.

That's rather ambiguous. Agree that IF a player is found to be fraudulent, then the program has the right to deduct bogus earnings. However, there also needs to be proof supplied to the affiliate/partner. Otherwise, this clause could be abused, in a fraudulant manner by the program et al.

11. The Affiliate program reserves the right to zero affiliates balance due to inactivity. Inactivity means one year (365 calendar days) with no attempts of signing into the affiliate account.

Whether an affiliate signs in or not, shouldn't be grounds for stealing commission & or referred players tagged to the affiliate.
