MyBet Partners is rogued at AGD for the following:


MAIN ISSUE:

They have used the following clause to remove an affiliate from their program with active players:

12. Term and Events of Default
a) This Agreement shall start on the date that myBet notifies the Affiliate that its application has been successful in accordance with Clause 4. This Agreement shall continue thereafter unless and until terminated in accordance with Clauses 12 (b), (c), (d) and (f) (hereinafter the "Term).
b) An Affiliate that has not contributed to any New Depositors in the relevant month may become subject of a review of their Affiliate status with the possibility of immediate termination of affiliate agreement or change of commission plan.
c) Notwithstanding Clause 12 (a), myBet may bring the Term to an end with immediate effect by written notice to the Affiliate if:
i. the Affiliate commits a breach of its material obligations under this Agreement and in the case of a remediable breach, fails to remedy it within 30 days of the date of receipt of notice from the other;
ii. the Affiliate becomes insolvent or unable to pay its debts, proposes a voluntary arrangement, has a receiver, liquidator, administrator or manager appointed over the whole or any part of its business or assets or if any application shall be presented, order shall be made or resolution passed for its winding up (except for the purposes of a bona fide amalgamation or reconstruction), bankruptcy or dissolution or if it shall otherwise propose or enter into any composition or arrangement with its creditors or any class of them, or it ceases to carry on business or if it claims the benefit of any statutory moratorium.
iii. the Affiliate sells its business, or any part herein, and/or registers any change of beneficial owner.
d) myBet has the right to change the commission plan and/or bring the Term to an end within a three month trial period, starting on the day the first referred customer has become active on any myBet product.
e) myBet shall forthwith give notice in writing to the other party of any event within clause 12(b) (ii) which occurs during the Term and which would entitle myBet to bring the Term to an end.
f) Any party may terminate the agreement at the end of each month with a 2 month notice period.
g) The parties shall have no further obligations or rights under this Agreement after the end of the Term, without prejudice to any obligations or rights which have accrued to either party at the time when the Agreement ends save that clauses 1, 2, 8, 9, 11, 12, 13(e), and 14, together with those other clauses the survival of which is necessary for the interpretation or enforcement of this Agreement, shall continue to have effect after the end of the Term.

The commission will be reset to zero (0) at the 1st of every month. myBet may exceptionally introduce negative carryover to certain affiliates if necessary and will inform the affiliate in such an event.</div>




It is not worthwhile as an affiliate to promote groups like this.

They also approached us and I did not even bother to reply to their e-mail. We've decided not to promote any new affiliate programs until they've proved themselves. This industry is going from bad to worse by the day!

This is beyond predatory! We had extensive talks with the team at MyBet over this issue. This being said the company big shots decided to stand by the T&C's they have in place and feel they are within their rights to steal money from affiliates. They are unwilling to make any changes to the Terms.

The updated terms are, at least, better. Though 15% sux.

Punishing affiliates, with the idea they'll reinstate promotions of a brand(s) or push brand(s) harder, to get NDP's, is counter productive. Instead, least for myself, if and when a program manager contacts me, and says... Hey Dave, is there anything "we, the program" can help you with, to help you boost NDP's?

It's this approach that will pay dividends for programs.

Treat people badly and they wont respond positively. Treat them well and encourage loyalty... Is the way to go

It's not only mybet - a number of other programs like Affutd / William Hill drop your rev share practically to nothing if you do not introduce new depositors in a given month.

Add to that list ActiveWins / Betfred - these sharks also drop rev share if you don't introduce new players.

A drop in rev share to 5% as with William Hill is as good as just closing the account.

It amazes me though that minnow brands like MyBet think they can play this game. They literally won't have any affiliates if they want to play hard ball like these, and not before long they'll get swallowed up by one of the big sportsbooks, either that or go bankrupt.

We are currently working with MyBet and mentioned previous reasons for being in the rogue category. They are working hard to rectify that - hence the recent terms updates.

I think you're being a bit harsh there - their terms actually say:
"12.4 If you do not deliver one (1) new depositing account within a period of three months (billed months) and/or or your affiliate account is exhibiting an unusual level of high net losses and you are no longer actively promoting Betfred, we may contact you to discuss your account. If we do not receive a positive response that you will actively promote Betfred.com in the future (and we can see evidence of this within 7 days) or a justifiable reason as to why you are exhibiting such an unusual level of high net losses, we may, in our absolute discretion, reduce any Lifetime Revenue payable to you to a default revenue share of 10% per previously introduced Customer with immediate effect or terminate this Agreement immediately by delivery of written notice to you."

So they are saying they will discuss the issue and explore ways to help you BEFORE dropping your Rev Share % as a last resort.

First of all I want to apologize that we didn't changed the Terms way back ... as I personally don't find them affiliate friendly and also useless

I also want to add here that we changed it a bit more :

An Affiliate that has not contributed to any New Depositors within a 6 months period may become subject of a review of their Affiliate status with the possibility to change of commission plan to 15% flat net revenue share.

Also we add '' may become'', I really tried to get this sentence out completly or get it to 30%, but that was not approved from senior management. But if at any point one of you get problems regarding this Term, i would be glad to hear back from you and i will sort it out.

As you see it is not always easy to have things done as we wish, but we tried our best to have the Terms changed.... and I annoyed Andy for a lot time
