Warning about the cooperation with WildTornado - CLOSED

I would like to inform you about a very unpleasant situation our company ended up in, connected with Wild Tornado affiliate program.

Wild Tornado Program has contacted our company and requested network services, we negotiated exclusive terms where we bring all our partners directly to their program without using any middle tracker.

Both parties signed IO where, where all payment terms and possible risks have been listed.

After the break in cooperation, the above partners remained in debt to us and have not paid us for several months.

They provide a small part of payments for the first time but later they stopped to pay us at all.

There have been few excuses and then we just stopped getting any replies from their team at all.

We know that they are still active and cooperate with some affiliates and networks. Hopefully this story will be a warning to their active or potential partners.

We already started the legal proccess against this company in the nearest future as this behavior goes in controversy with terms in the contract signed, not talking about the moral part of this situation.

Agreed, these guys are crooks and they have been blacklisted a long time ago on our site.

On a sidenote, I dont understand the deal you made with them. They got sent traffic without the use of an affiliate link?

We have no deals like this one and to be honest we have signed maybe 1-2 deals in all the time working as affiliates which is over 20 years.

But i can say that our partnership with WildTornado is also not very successful.

Everything that is written above about the situation with the “Affidelity” company is true.
But there are a few details missing that we want to add from our side, which are not mentioned here.
1- “Affidelity” offers its partner base to cooperate with us and we are obliged to transfer our partner base to them so that they can work with it. That is, we did not have the right to search for new partners and work with current partners. But we could observe the work in correspondence on Skype groups and approve deals, hoping that they would be of high quality. There were partners who themselves came looking for new cooperation with us, but they were offered in the beginning other brands, which the “Affidelity” served as well. We don't know how many of these communications were behind our back. But the fact that we have discovered that our partners are being lured to cooperate with our competitors is a fact.
2- Every month the accountant comes to reconcile the accounts and confirm the payment from our side for the benefit of the “Affidelity”, she also asked to withdraw the payment for one partner to their account, which was strange. It turned out that this is a base / traffic that belongs to the company itself and they poured it to the amount of 13,700 euros. Without notifying in advance that it was their player base. They also removed the baseline there, although they put it for all partners as it was agreed in advance. But we agreed to pay for that too.
3- After these situations, we decided that it is necessary to stop such unfair cooperation with “Affidelity”. But in order to terminate the contract, we had to pay 100% of the possible profit for the whole year. Example: we take the last month and multiply its profit by the whole year.
As many know, who analyzed the traffic, that the average life of players, the arithmetic mean, is 3 months. They in turn assure that the traffic of their partners carries the same profit for a whole year. I repeat, the same profit for a whole year. We paid half of this amount, which we think is more than fair.
We believe that this situation should be considered by the court and decide fairly who is right and who is wrong in this situation.

We thank the representative of WildTornado Partners for their response and acknowledgment that the information we provided is true, which generally acknowledges our correctness and, in particular, the obligation of WildTornado Partners to adhere to the terms of the agreement regarding financial obligations.

However, we, in turn, cannot recognize the information from WildTornado Partners as truthful because of the following argumentation.

WildTornado Partners approached us with a request to provide the affiliate management services; on our part, we offered conditions for the full management of affiliates, including management of existing affiliates (active/inactive) and recruitment of new affiliate that is not yet under WildTornado Partners database. We, as a reputable company, had a large base, which was the reason that WildTornado Partners approached us. It is worth pointing out that the agreement with WildTornado Partners did not provide for exclusive conditions, since in our large database there were many who were already in the WildTornado Partners database. We have made every effort to ensure that affiliates are active with WildTornado Partners, however affiliates may also list many other brands in addition to WildTornado Partners. Thus, WildTornado Partners are trying to impose their untruthful opinion on the public, or their words indicate a complete misunderstanding of business processes, in particular working with affiliates and the terms of cooperation that were signed by WildTornado Partners. But this does not in any way change the fact that affiliates place many brands on their sites, and not just WildTornado Partners site. And they decide who will receive more traffic based on the numbers, namely the deal (which is confirmed exclusively by WildTornado Partners) and product indicators, for which WildTornado Partners is responsible.

At the time of cooperation with WildTornado Partners, our company had a media buying department, that is, we were a direct affiliate. Also, according to the terms of cooperation, connecting affiliates was our direct responsibility, regardless of whether the affiliate belongs to us or not. According to the terms of cooperation, all deals and payments were to be and were directly approved exclusively by WildTornado Partners. Such terms of cooperation are one of the operating principles of our company in order to ensure that the client is confident and convinced of our honesty and integrity, as well as to eliminate the risks of the human factor on our part. Thus, WildTornado Partners is trying with all its might to create the appearance of a situation in its favor, however, the only goal of WildTornado Partners is to justify its refusal to fulfill financial obligations under the agreement with our company.

We encounter (as in this particular case) dishonest brands in our industry and that is why we insist on signing contracts. We know that many brands use service providers, as well as employees (affiliate managers), who are hired only to suck up the base and then, after a few months, fire/terminate the agreement and use the base for free. This is exactly what was done in this case. And it is precisely these risks that we have written down in the contract. In case WildTornado Partners decides (as he did) to get a base while we do the hard work and connect them with affiliates, and then say goodbye exactly when affiliates start generating the income. Twelve months has nothing to do with the lifetime of the customers, as WildTornado Partners writes. We did not bring customers, but affiliates who will continue to work with Wild over time and will bring new customers every day, who in turn will continue to generate profit for WildTornado Partners.

In general, we would like to draw attention to the fact that WildTornado Partners first asked for a deferred payment when terminating the contract, and paid in installments (without first abandoning its obligations). Our company has always made concessions and treated the problems of WildTornado Partners with understanding, despite the fact that WildTornado Partners wanted to solve these problems at our expense. However, WildTornado Partners then stopped communicating, and now refers to clearly fictitious facts in order to mislead the public.

Based on the above, we once again warn all affiliates not to work with WildTornado Partners or to work on a 100% prepayment basis. This will save both your nerves and your legal funds.

We, in turn, provided that WildTornado Partners does not fulfill its obligations to our company, will address this case to other authorities.

From our side we`d also like to inform the forum members that as soon as WildTornado Partners will take the initiative to resolve this issue and contacts us directly, we will close all complaints and report about this the WildTornado Partners and the forum members.​

Sounds like it's a case for the courts to decide.

FYI...I'm not taking sides here BUT there are a few things that don't add up.

Generally speaking, matters like this, when disputing parties can afford legal council, and furthermore, have the means to take this dispute to court, rarely, if ever, post about it to affiliate forums.

I'm wondering why the OP did this.

Was it to try and force Wild Tornado Partners into settling the OP's payment demand.

Given how a large % of affiliate programs have mistreated their affiliate-partners over the years, programs these days are viewed with a deal of caution. In saying that, it wouldn't be too hard to discredit a program. Hence, use this to force payment, even if payment isn't owed... just sayin!
