This is new email received today

We have tried to contact you without success regarding the changes that need to be made in line with UK Gambling (Licensing and Advertising) Act 2014, which came into force on 1st November 2014.
According to our records we have not received a response from you on this, and therefore we have suspended your affiliate account with immediate effect.
This is your last chance to let us know that you are compliant with the new regulations, or if you feel they do not apply to you as you are promoting 32Red outside the UK. If you do not respond to this email within the next 30 days, by the 12th February 2015 then your account with 32Red will be permanently closed.
Should you have any questions on this, or wish to contact the 32Red Affiliate Team please emailaffiliates@32red.com.

Affiliate Username:

URGENT REMINDER - IMPORTANT REGULATORY COMMUNICATION - ACTION NEEDED

You were sent the email below due to the recent changes in regulation of the UK gaming market that were in effect as of November 1st. With the introduction of this legislation we are required to ensure the way that we operate continues to be compliant and we are allowed to continue to operate within the UK market. Part of this is to ensure our marketing material is compliant with the UK CAP codes.

We have not had a response from you to confirm you are using the most up to date and correct creative for the UK market. Please ensure you do so by this Friday 21st November, as failure to do so will result in your affiliate account being suspended.

If you have responded within the last 24 hours please ignore this communication, as it can take some time for our system to update.

You are no doubt aware of the changes in regulation of the UK gaming market from the 1st November 2014 with the introduction of the Gambling (Licensing and Advertising) Act 2014 and 32Red is proud to have a UK Gaming licence (No3940). With the introduction of this legislation we are required to ensure the way that we operate continues to be compliant and we are allowed to continue to operate within the UK market.

Part of this is to ensure that our marketing material is compliant with the UK CAP codes that regulate what can and cannot be said in advertising. To ensure that we are compliant with the regulations we are asking all of our partners to ensure that you are using the latest versions of the affiliate creative that is available in the 32Red Affiliate Portal, and that you are showing the correct details of current bonuses that are available to new players. To help this process we ask that you are only using the dynamic creative from the system and not hard coding these into your sites. To ensure that you are only using correct creative for the UK market we have restricted the sizes that are available to:

- 728x90
- 468x60
- 120x600
- 160x600
- 300x250
- 300x600

Mobile banners are also available in the following sizes:

- 320x48
- 300x100
- 300x50
- 90x60
- 320x50

We will be adding new creative to the Affiliate Portal as time goes on. The creatives that are available are the only ones that should be used, and you must not alter or edit them in any way.

What you need to do now:
1. Log in to the 32Red Affiliate Portal and ensure that you are using the latest creative
2. Update any banners that are out of date.
3. Replace any hard coded creative with the dynamic ones in the portal.
4. Update any copy, reviews or tables with our current offers (below). Any old offers should be removed or marked as expired.
5. Email affiliate.compliance@32red.combefore 21/11/2014 to confirm that you are using the latest promotional material.

We would like to remind you that it is your responsibility as a 32Red affiliate to ensure that you are using the most up to date creative as per clause 4.3 of the Terms and Conditions of the affiliate programme. Any breach of this clause could cause your affiliate account to be suspended and/or terminated by us.

It is also important to note that in addition to our Terms and Conditions the terms of our licence require us to ensure our affiliate partners continued compliance as per 1.1.3 of the UK Gambling Commission Social Responsibility code.

thanks so much for your red carpet treatment, second to none yeah - not !

they can close my account - whatever - I do not trust them anyway.

besides that UK players from other programs have never been transferred to my 32Red account, despite several requests.

A sign of the times as the Net becomes over saturated with online casinos, and sponsors struggle for more exposure and traffic while looking for ways to cut costs.

A sign of the times as the Net becomes over saturated with online casinos, and sponsors struggle for more exposure and traffic while looking for ways to cut costs.

Every casino out there can't sustain this type of competition, indefinitely and these cost cutting exercises, are becoming more prevalent.

First it's affiliates (as we have seen across other brands), next it will be players. Until numbers are culled, it's going to get a lot worse.

But it's just not an over population of casinos etc, it's an over population of affiliates too. Every man and his dog has jumped into the industry, thinking, it's a gold mine. Add in the hackers, spammers etc. For most of us it's why the pickings are lean and our incomes have taken a hit!

Fortunately my living expenses are relatively cheap and if need be I can likely ride this out. However those who have families, mortgages etc etc, when these "cuts" get tighter, I can envisage a mass exit of affiliates who simple can't not weather the storm.

I got the same e-mail too - and was pretty pissed at the wording. :(
I am probably just a small fish to them - but they are in my top 5 best performing programs, so it means a lot to me.

I also got the original e-mail about what changes were needed and immediately acted on it - but it does look like I forgot to e-mail them back confirming I was compliant, so I guess I sort of deserved it.
I was also annoyed by this first mail too, because they don't list any 125x125 banners, which are the main size I use!

What's REALLY confusing are all the different types of BONUS OFFERS in the Category section of the Media Gallery. These display banner sizes which are NOT in the above lists.

If we (affiliates) are to be compliant, then I'd expect the affiliate program to follow suit!

Also, is this compliance ONLY for UK portals?

This is where this mailer become VERY ambiguous, given what I've outlined above.

NB - I got pulled up on a .co.uk site, which I haven't owned for years. So my guess, this mailer is only regarding UK facing portals. BUT without actually being told this, I'm clueless to what is OK and what is NOT OK.

And one final though, even though I specifically don't target UK players and I don't currently have any active .co.uk portals, I still get site visitors from the UK, on my none UK domains. So what are the compliance rules pertaining to these sites?

I, like many other affiliates, don't currently have GEO targeting on any of my sites.

It's all very, very confusing

After receiving note of account suspension, I removed links and contacted them that I don't have UK sites, BUT received this

In order to remain compliant and keep your account open you need to be actively promoting us.
and I do send traffic and a few players per month, do I missed anything about there terms?

In order to remain compliant and keep your account open you need to be actively promoting us.

So does this mean...
Even if we have active players BUT stop promoting 32Red et al; even if they are NOT producing sign-ups, we run the risk of having our affiliate account terminated. Seriously?
